Terms and Conditions (T&C)

Effective Date: September 22, 2025

1. Provider, Scope, Language

These Terms and Conditions (T&C) govern the use of our website and all purchase agreements made via this website between

and consumers as well as – unless explicitly excluded – business customers ("Customer", "you").

The contract language is German. An English translation is provided for international customers; in case of conflict, the German version shall prevail.

2. Customer Group & Minimum Age

Our services are primarily aimed at consumers as defined under EU law. Minimum age: 16 years. Parents/legal guardians are liable for orders placed by minors.

3. Products, Print-on-Demand & Product Presentation

  1. Print-on-Demand: All physical products are produced only after an order is placed. Minor deviations in color/size may occur due to manufacturing and do not constitute defects as long as the ordinary use is not impaired.

  2. Personalized Products: Only products explicitly marked as "personalized" (e.g., containing customer-provided data/designs) are considered customized. Special rules on withdrawal apply (see § 12).

  3. Digital Content (if offered) is delivered electronically; system requirements are indicated in the product description.

4. Product Safety (EU-GPSR) & Traceability

We comply with the General Product Safety Regulation (EU) 2023/988, including product safety obligations, traceability (e.g., manufacturer/importer contact on packaging or documents), market surveillance, incident management, and recalls where required. 5. Pre-Contractual Information / Incorporation of T&C

Before contract conclusion, we provide clear information about:

  • essential product features,

  • total price including taxes/shipping,

  • delivery period,

  • withdrawal rights,

  • payment & delivery conditions.

These T&C become part of the contract if made available before ordering and if you have confirmed acceptance (e.g., via checkbox).

6. Offer, Ordering, Contract Conclusion

Product displays are not binding offers. By clicking "Buy", you submit a binding offer. The contract is concluded once we confirm the order via email. We may reject orders for legitimate reasons (e.g., fraud suspicion, pricing errors, legal restrictions).

7. Prices, Taxes, Duties

All prices are in EUR and include VAT unless otherwise indicated. Shipping costs are displayed separately during checkout.
Outside the EU, import duties, taxes, or brokerage fees may apply; the customer is responsible for these. Currency conversion or card fees may be charged by your payment provider.

8. Payment Methods & Processing

Accepted payment methods: Visa, Mastercard, Amex, PayPal, Apple Pay, Google Pay, Shop Pay, Cryptocurrencies (BTC, ETH, LTC, DOGE, USDC via Coinbase).
Payment is due immediately; production/shipping starts after receipt of payment. Payments are processed via third-party payment providers; their terms may apply.

US Note (Warranties): We do not issue a separate "written warranty" under the Magnuson-Moss Warranty Act; mandatory statutory warranties remain unaffected. Disclaimer limitations apply only where legally permitted.

9. Delivery, Production Sites, Delivery Times, Transfer of Risk

  1. Worldwide delivery via fulfillment partners; production and shipping typically occur regionally (e.g., EU: mainly Latvia; USA: local sites) for faster delivery.

  2. Delivery Times (non-binding): EU/USA approx. up to 8 business days, international orders up to 10 business days. Delays may occur due to customs, capacity, or force majeure.

  3. Risk Transfer: For consumers, risk passes upon delivery; if you arrange your own carrier, risk may pass earlier per applicable law.

  4. Failed Deliveries: If the parcel cannot be delivered (wrong address/refusal), we will contact you; additional re-shipping costs may apply.

  5. Transport Damage: Please document and report immediately; statutory rights remain unaffected.

10. Retention of Title

Goods remain our property until full payment has been received.

11. Warranty (Defects) & Procedure

  1. EU Minimum Standard: Statutory warranty rights of at least 2 years from delivery for conformity defects; reversal of burden of proof for at least 1 year from delivery (in some countries 2 years).

  2. Procedure: Report defects promptly (photo/description). We will repair, replace, or refund according to statutory provisions.

  3. Product Liability: Mandatory liability under applicable product liability law remains unaffected.

12. Right of Withdrawal (EU Consumers)

  1. Period: 14 days from receipt of goods (EU consumers).

  2. No Withdrawal for:
    – customized goods made to the customer's specification;
    – digital content if performance has started before withdrawal period expiry and you expressly agreed.

  3. Exercise: Send an email to team@cryptoonthewall.at with a clear withdrawal declaration.

  4. Consequences: Refund within 14 days from withdrawal notice; we may withhold refund until return shipment or proof thereof. Return shipping costs borne by you, unless goods are defective/incorrect – then we bear the cost.
    (UK Note: UK Consumer Rights Act 2015 provides similar but separate rules; mandatory UK law remains unaffected.)

13. Liability

  1. Unlimited liability for intent, gross negligence, and damages to life, body, health.

  2. For ordinary negligence, liability only for essential contractual obligations ("cardinal obligations") and limited to typical foreseeable damages.

  3. No liability, where legally permitted, for:
    – temporary technical outages, downtime, compatibility or performance issues,
    viruses/malware despite standard precautions,
    data loss on the customer side without our fault,
    third-party content/links (§ 18).

  4. Mandatory liability (e.g., product liability, fraudulent concealment) remains unaffected.
    (US Note: Some states do not allow exclusion/limitation of implied warranties or consequential damages. Clauses apply only where legally permitted.)

14. Promotions, Presale, Vouchers

Promotions/discounts apply only within the indicated period. One code per order; no cash payout; misuse leads to revocation. Obvious pricing errors entitle us to correct/void the transaction; paid amounts will be refunded.

15. Fraud Prevention, Order Checks, Account Suspension

We may verify orders/payments (fraud checks), cancel suspicious transactions, and suspend accounts for legal violations. Statutory rights remain unaffected.

16. Export Controls & Sanctions Compliance

Deliveries to countries/regions subject to export/sanction restrictions are excluded. Customers warrant compliance with applicable export control/sanctions laws.

17. Website Acceptable Use

Prohibited: unlawful content, IP rights infringement, automated scraping, circumvention of security measures, disruption of infrastructure. We may suspend accounts or take legal action in case of violations.

18. Third-Party Content & External Links

Our website may contain third-party content/links. We have no control and – to the extent legally permitted – assume no liability for availability, legality, accuracy, or security of such third-party services.

19. Intellectual Property

All designs, images, texts, trademarks, and other content are protected. Any use beyond legally permitted purposes requires prior written consent. For personalized orders, you grant us a simple, purpose-bound license to reproduce your submitted content for manufacturing purposes; you warrant non-infringement of third-party rights and indemnify us accordingly.

20. Data Protection

We process personal data in accordance with GDPR and applicable privacy laws. See our Privacy Policy (link in the footer).

21. Assignment / Transfer

We may assign/transfer rights or obligations under this contract (e.g., production/logistics partners). Customers may transfer rights/obligations only with our prior written consent.

22. Force Majeure

We are not liable for delays/performance failures due to circumstances beyond our control (e.g., natural disasters, war, strikes, power outages, pandemics, supply chain disruptions). Deadlines extend by the duration of the disruption plus reasonable start-up time.

23. Amendments to T&C

We may amend these T&C for future transactions. The version in force at the time of order applies. For ongoing obligations (if any), we notify in advance; objections/cancellation rights remain unaffected.

24. Language, Interpretation, Precedence

In case of doubt, the consumer-friendly interpretation prevails. In case of language discrepancies, the German version prevails. Individual agreements (in text form) override these T&C.

25. Severability / No Waiver

If any provision is invalid/unenforceable, the remainder remains effective; statutory law replaces the invalid provision. Failure to enforce rights does not constitute a waiver.

26. Governing Law, Jurisdiction, Dispute Resolution

Governing Law: Austrian law applies, excluding the UN Sales Convention (CISG). Mandatory consumer protection laws at the customer's residence remain unaffected.
Jurisdiction: Where permitted, Salzburg, Austria.

Alternative Dispute Resolution (EU): The EU ODR platform was discontinued on July 20, 2025. For current consumer dispute resolution, see European Commission – Consumer Redress. We are willing to seek amicable solutions.

27. Regional Notes (Non-Exhaustive; Mandatory Law Prevails)

(A) European Union (EU/EFTA):
– Statutory 2-year warranty, reversal of burden of proof min. 1 year (some states 2 years). GPSR product safety obligations apply.

(B) United Kingdom (UK):
Consumer Rights Act 2015: rights for conformity, repair/replacement, price reduction/termination. 14-day withdrawal right under UK distance selling law; mandatory UK rules prevail.

(C) United States (USA):
Magnuson-Moss Warranty Act/FTC rules: If a "written warranty" is issued, disclaimer of implied warranties is heavily restricted. We issue no separate written warranty; statutory rights remain unaffected.

(D) China / Mainland China:
Law on the Protection of Consumers’ Rights and Interests (LPCRI): strict information & consumer rights obligations. Local mandatory rules prevail.

(E) Other Countries:
– Many jurisdictions have mandatory consumer rights, warranty rules, and information obligations. These T&C apply only insofar as local mandatory laws do not override them.
